Acceptance of Terms
By creating an account or using the Setlist platform (“Service”), operated by Setlist (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
Description of Service
Setlist is a platform that connects local musicians and independent music venues. It enables musicians to create electronic press kits (EPKs), display booking information, and connect with venues. Venues can discover artists, manage bookings, and track what's working in their rooms.
The Service is currently in early access and primarily serves the Salt Lake City, Utah live music community. Features and availability may change as the platform grows.
Eligibility
You must be at least 18 years old to use Setlist. By using the Service, you represent that you meet this requirement. The Service is intended for musicians and venue operators; fan accounts are not yet available.
Account Registration
You may register using your email address or via Google Sign-In. You are responsible for:
- Keeping your login credentials confidential
- All activity that occurs under your account
- Providing accurate and truthful profile information
- Notifying us promptly of any unauthorized account access
We reserve the right to suspend or terminate accounts that violate these Terms.
Acceptable Use
You agree not to use Setlist to:
- Post false, misleading, or fraudulent information
- Impersonate another person or entity
- Harass, threaten, or harm other users
- Spam or send unsolicited messages
- Scrape, crawl, or otherwise harvest data from the platform
- Attempt to gain unauthorized access to other accounts or systems
- Violate any applicable law or regulation
We may remove content and suspend accounts that violate these rules at our sole discretion.
User Content
You retain ownership of content you submit to Setlist (bio, photos, music links, etc.). By posting content, you grant Setlist a non-exclusive, worldwide, royalty-free license to display and distribute that content within the platform for the purpose of operating the Service.
You are solely responsible for the content you post. Do not post content you do not have the right to share, including copyrighted material, private information about others, or defamatory statements.
Third-Party Services
Setlist integrates with third-party services including Google (authentication), Spotify (artist metrics), and YouTube (video embeds). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.
Termination
You may delete your account at any time by contacting us at hello@setlist.app. We may suspend or terminate your account for violations of these Terms or for any other reason at our discretion, with or without notice.
Disclaimer of Warranties
Setlist is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific requirements. We make no warranties regarding the accuracy or completeness of any content on the platform.
Limitation of Liability
To the fullest extent permitted by law, Setlist shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost profits, lost data, or business interruption.
Our total liability to you for any claim arising from use of the Service shall not exceed the greater of $100 or the amount you paid us in the past 12 months.
Intellectual Property
All Setlist branding, design, software, and content created by us is our intellectual property. You may not reproduce, distribute, or create derivative works without our written permission.
Changes to These Terms
We may update these Terms from time to time. We will notify users of material changes by updating the “Last updated” date above. Continued use of Setlist after changes constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Salt Lake County, Utah.
